1. Name Registration
Perpetual Progress will not activate any Domain Name unless it is satisfied that it has received a reasonable assurance of payment of the registration fee. Customer agrees to pay the registration fee upon activation of the registration.
ALL SALES OF INTERNET DOMAIN NAMES ARE FINAL.
2. Name Identification Information
As the person legally responsible for registration of a Domain Name, you agree to supply Perpetual Progress with a current and truthful name, postal address, email address, and telephone number for our records, and you have a continued obligation to keep this information current. You also agree that you are an authorized user of any credit card that you supply to us or our payment partner(s), and you understand and agree that we have an obligation to fully investigate any possible fraudulent credit card use.
You agree that willfully providing inaccurate or unreliable contact information and/or failing to promptly update contact information within 15 days upon a request from Perpetual Progress may be a cause for cancellation of the Domain Name at the discretion of Perpetual Progress.
3. Name Usage
You represent that, to the best of your knowledge and belief, that neither the registration of the Domain Name nor the manner in which it is directly or indirectly used infringes the legal rights of any third party.
4. Name Auto Renewal
You agree, that unless otherwise requested, Perpetual Progress will automatically renew your Domain Name. You agree to pay the renewal fee at established rate at the time of the renewal.
5. Name Transfers
Perpetual Progress respects your rights as a customer to transfer your Domain Name to another registrar at your discretion. However, Perpetual Progress may deny an outbound domain name transfer for any of the following reasons:
– Evidence of fraud
– UDRP action
– Court order by a court of competent jurisdiction
– Reasonable dispute over the identity of the Domain Name Registrant or Administrative Contact(s)
– Non payment (including credit card charge-backs) for previous or current registration periods
– Express written objection to the transfer from the Domain Name Registrant or Administrative Contact(s)
– The Domain Name is in “locked” status
– The transfer is requested within 60 days of the creation date as shown in the WHOIS database
– The transfer is requested within 60 days of being transferred to Perpetual Progress, unless transferred to the previous registrar
6. Name Expiration and Redemption
You agree that by providing notice that a Domain Name is to be cancelled or after non-payment of a registration/renewal fee, that the Domain Name will be placed in “locked” status and may only be unlocked if current registration fees are paid and the Domain Name registration will be cancelled by the end of the current registration period. In the case of non-payment, WHOIS information may be updated to indicate that the name is “subject to dispute”.
You agree to pay a redemption fee of $200 should you request to renew a Domain Name that has previously expired. Perpetual Progress cannot guarantee the redemption of any given Domain Name.
7. Warranty, Liability, and Indemnification
Perpetual Progress makes no warranties or representations of any kind for the services being offered. The service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement, or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by Perpetual Progress or its agents or employees shall create a warranty. Perpetual Progress provides no warranty that the service will be uninterrupted or error free. Under no circumstances shall Perpetual Progress be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from your use of or inability to use the Domain Name or for any failure of performance.
8. Changes to the IDNP
Perpetual Progress reserves the right to revise its policies at any time without notice.
